1. Introduction

1.1 These Terms and Conditions ("Terms") govern your access to and use of FluxRPC and its associated services, tools, and interfaces (the "Website"), accessible at https://fluxrpc.com.

1.2 By accessing or using the Website in any capacity, you confirm that you have read, understood, and agree to be bound by these Terms. If you do not agree, you must immediately cease using the Website.

1.3 We reserve the right to modify these Terms at any time. Changes take effect immediately upon posting. Your continued use of the Website constitutes acceptance of any revised Terms.

2. Eligibility

2.1 By using the Website, you represent and warrant that:

• You are at least 18 years of age or the age of legal majority in your jurisdiction, whichever is greater;
• You are not located in, incorporated in, or a resident of any jurisdiction subject to comprehensive sanctions (including OFAC, EU, or UN sanctions lists);
• You are not a designated individual or entity on any sanctions or watchlist maintained by any governmental authority; and
• Your use of the Website is lawful in your jurisdiction.

3. Description of Service

3.1 The Website provides access to a non-custodial decentralised application (dApp) interface interacting with smart contracts deployed on the Solana blockchain ("Fluxbeam").

3.2 The Website is not a broker, exchange, financial institution, or payment service provider. Nothing on this Website constitutes financial, investment, legal, or tax advice.

3.3 The Website may integrate third-party services for convenience. Such integrations will be clearly identified. We accept no responsibility for third-party services, and your use of them is at your sole risk.

4. Intellectual Property

4.1 All content, software, trademarks, and materials on the Website are the property of FluxRPC or its licensors, except where covered by open-source licences.

4.2 Any feedback or suggestions you voluntarily provide regarding the Website may be used by us freely and without obligation to you. You retain ownership of any other content or information you provide.

5. Prohibited Conduct

You agree not to use the Website to:

• Violate any applicable local, national, or international law or regulation;
• Engage in money laundering, terrorist financing, fraud, or sanctions evasion;
• Interact using funds derived from darknet marketplaces, mixing services, or exchanges that do not conduct KYC;
• Engage in market manipulation, wash trading, or any deceptive trading practices;
• Interfere with or compromise the integrity or security of the Website; or
• Use funds from gambling services or other prohibited sources.

We reserve the right to restrict or terminate access for any user we reasonably believe is in violation of this section.

6. Risk Disclosure

6.1 By using the Website, you expressly acknowledge and accept the following risks:

• Volatility: Digital assets are highly volatile and may lose value rapidly or entirely;
• Regulatory risk: The regulatory environment for digital assets is evolving and may adversely affect your use of the Website or the value of your assets;
• Technology risk: Smart contracts, blockchain networks, and related technology may be subject to bugs, hacks, exploits, or failure;
• No guarantee: We make no representation regarding the continued availability, performance, or value of the Website or any digital asset; and
• Self-custody: You are solely responsible for the security of your wallets and private keys. We have no ability to recover lost assets.

6.2 You are strongly encouraged to seek independent financial and legal advice before using the Website.

7. Disclaimer of Warranties

7.1 The Website is provided on an "as is" and "as available" basis without warranties of any kind, express or implied, including but not limited to merchantability, fitness for a particular purpose, or non-infringement.

7.2 We do not warrant that the Website will be uninterrupted, error-free, or free of harmful components.

8. Limitation of Liability

8.1 To the maximum extent permitted by applicable law, FluxRPC and its affiliates, officers, directors, and employees shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of profits, loss of data, or loss of digital assets, arising out of or related to your use of the Website.

8.2 Our aggregate liability to you for any claim arising out of these Terms shall not exceed the total fees paid by you to the Website in the twelve (12) months preceding the event giving rise to the claim.

8.3 Some jurisdictions do not allow the exclusion of certain warranties or limitation of liability. In such jurisdictions, our liability is limited to the fullest extent permitted by law.

9. Indemnification

You agree to indemnify, defend, and hold harmless FluxRPC and its affiliates, officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or related to: (a) your use of the Website; (b) your breach of these Terms; or (c) your violation of any applicable law or third-party rights.

10. Privacy and Data

10.1 Your use of the Website is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

10.2 To the extent you are located in the European Economic Area or United Kingdom, our Privacy Policy sets out your rights under applicable data protection law.

11. Termination

11.1 We may suspend or terminate your access to the Website at any time and without notice, at our sole discretion.

11.2 Sections 4, 7, 8, 9, and 12 survive termination of these Terms.

12. Governing Law and Dispute Resolution

12.1 These Terms are governed by and construed in accordance with the laws of St. Vincent and the Grenadines.

12.2 Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of St. Vincent and the Grenadines, except where prohibited by the mandatory laws of your jurisdiction.

13. Miscellaneous

13.1 Severability: If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions continue in full force and effect.

13.2 Entire Agreement: These Terms, together with the Privacy Policy, constitute the entire agreement between you and FluxRPC regarding your use of the Website.

13.3 Waiver: Our failure to enforce any right or provision shall not constitute a waiver of that right or provision.

13.4 Assignment: We may assign our rights and obligations under these Terms without notice. You may not assign your rights without our prior written consent.

13.5 No Third-Party Beneficiaries: These Terms do not create any rights in any third party.
